Victims of violent crime or vehicular battery, are entitled to certain rights under the provisions of the 1991 South Dakota Victims Rights Act. Although victims are entitled to be notified of rights by the prosecutor, they must inform the prosecutor if they want to exercise these rights.

The Victims Services Program administers state and federal grants that provide funding to programs that offer shelter, advocacy, crisis counseling, and other victims' services to sexual assault, domestic violence, stalking, and other violent crime victims. Crime Victims' Compensation is available for personal injury expenses incurred as a direct result of the violent criminal acts of another person.
